By instructing a certified enforcement agent, landlords can seize and sell a tenant\u2019s goods to recoup what\u2019s owed.<\/p>\n<p>\u201cIt\u2019s a structured, lawful procedure introduced by the Tribunals,\u00a0Courts\u00a0and Enforcement Act 2007, and it replaced the old common-law right of distress with a system that aligns with modern enforcement standards and human rights legislation.<\/p>\n<p>\u201cAt RG Law, we find that many landlords are either unaware of CRAR or wrongly believe it\u2019s a hostile tactic.\u00a0In reality, it\u00a0can be part of a professional, transparent rent recovery strategy. It encourages settlement, protects landlord cash flow, and avoids the escalating costs of litigation. Used correctly, it doesn\u2019t have to damage landlord-tenant relationships\u2014it can help save them.\u201d<\/p>\n<\/p>\n<p>CRAR applies under strict conditions:<\/p>\n<ul>\n<li>It only recovers pure rent (not service charges or insurance).<\/li>\n<li>The lease must be written and cover wholly commercial premises.<\/li>\n<li>The right to forfeit is waived if CRAR is used.<\/li>\n<li>Enforcement agents must be certified and follow a structured process, including a 7-day notice period before goods can be seized.<\/li>\n<\/ul>\n<p>Goods essential to the tenant\u2019s trade (up to a specified value) cannot be seized, and a separate notice must be served before any sale.<\/p>\n<p>Landlords are failing to use CRAR owing to a lack of awareness, fear of confrontation, and misconceptions about the law, according to Remit Consulting.<\/p>\n<p>Ngenegbo added: \u201cCommercial landlords are businesses too.<\/p>\n<p>\u201cCash flow is vital \u2013 especially when lenders are involved.
